Special reasons not to disqualify you - save your licence

This video is about Section 81 of the Land Transport Act relating to the court finding 'special reasons' to not disqualify you even in the face of a 'mandatory' disqualification. The court has the power to reduce a disqualification or impose none at all. It relates to the offence not the circumstances of the offender.

Understanding New Zealand Law: Special Reasons Not to Disqualify You

If you're facing a mandatory disqualification in New Zealand, there's a provision in the law that could potentially save your license. This provision, known as Section 81 of the Land Transport Act, allows the court to impose a shorter disqualification or no disqualification at all in certain circumstances.

What is Section 81 of the Land Transport Act?

Section 81 of the Land Transport Act is a provision that allows the court to consider special reasons why you should not be disqualified. However, it's important to note that these special reasons do not relate to your personal circumstances. The court won't consider arguments such as "I'm a nice guy" or "I haven't been in trouble before". Instead, the special reasons must relate to the actual offending.

Examples of Special Reasons

For instance, if you were in a rural community with no cellphone reception and your friend had a severe injury, and you had been drinking but had to drive to the hospital, you might still be charged with drink driving. However, the court could potentially decide that you shouldn't be disqualified in this instance.

While this is an extreme example, there are many other cases where people have managed to convince the court that they shouldn't be disqualified. Each case is approached on a case-by-case basis, and there's no specific definition of what constitutes a special reason.
